What is this Program about?

We want to thank you for being a Soundtrack superuser and invite you to be part of our Referral Program (the “Program”). By inviting your friends to sign up and becoming paying Soundtrack customers, you will earn a referral reward (the “Reward”). The Reward is a free month on one sound zone.

To complete a referral and earn your Reward, start by sharing your unique referral link with your friends. Once a friend has signed up using your link and has become a paying customer, you will both automatically get your Rewards. The Reward is conditioned on these Referral Program Terms & Conditions (the “Terms”), so please keep reading to find out how this Program works.

Who can be part of the Program?

Any paying customer of Soundtrack is eligible to invite friends. All referred friends must be new and first-time users of Soundtrack. Existing customers cannot participate in and benefit from the Program.

How do I earn my Reward?

Both the Referring Users (“you” or “your(s)”) and the invited friend will get the Reward when the friend has signed up with Soundtrack and become a paying customer, after the initial 14 day trial period.

When and how do I get my Reward?

If you are a single-zone customer on a monthly billing cycle, you will get the Reward in the billing cycle which follows after the invited friend has become a paying customer. 

The same applies if you are on a quarterly/annual billing cycle, in which case you will only be billed for 2 months (quarterly cycle) or 11 months (annual cycle) on your next bill after the invited friend has become a paying customer.

If you are a multi-zone customer on a monthly billing cycle, the Reward will be applied to one of your sound zones in the billing cycle which follows after the invited friend has become a paying customer.

The same applies if you are a multi-zone customer on a quarterly/annual billing cycle, in which case one of your sound zones will only be billed for 2 months (quarterly cycle) or 11 months (annual cycle) on your next bill after the invited friend has become a paying customer.

Multiple Rewards

If you are a single-zone customer on a monthly billing cycle, you will get the Rewards in the billing cycles which follow after the invited friends have become paying customers.

The same applies if you are on a quarterly/annual billing cycle, in which case the number of earned Rewards will be applied in the billing cycle which follows after the invited friends have become paying customers. For example, if you are on an annual subscription and earn 3 Rewards during your current billing cycle, we will charge you for 9 months instead of 12 in the following billing cycle.

If you are a multi-zone customer on a monthly billing cycle, the Rewards will be applied to the matching number of sound zones in the billing cycle which follows after the invited friends have become paying customers.

The same applies if you are a multi-zone customer on a quarterly/annual billing cycle, in which case the number of earned Rewards will be deducted from your invoice in the billing cycle which follows after the invited friends have become paying customers. For example, if you are on an annual subscription and earn 3 Rewards during your current billing cycle, we will charge one of your zones for 9 months instead of 12 in the following billing cycle.

Privacy

All personal information collected and processed as part of this Program will be used in accordance with Soundtrack Technologies’ Privacy Policy, available here. Under the applicable laws and regulations, Soundtrack Technologies shall be responsible for collecting and processing such personal information. 

You undertake to respect the privacy rights of the people you invite to our Program and direct to our website.

General 

These Terms are published by Soundtrack Technologies (“we”’, “us” and “our”). Our Program as governed by these Terms form a binding agreement for both you and people who receive a referral invitation.

Restrictions

By participating in this Program, we may restrict you from any other promotion, program, discount, or vouchers.

You understand and agree that you must not use referral methods that are bothersome to the recipients. Moreover, your participation in the Program must not violate the applicable law, including but not limited to anti-spam legislation, which is mass distribution of unsolicited messages.

You must not publish our Program on any sites or platforms that house any adult content, alcohol, tobacco, gambling, games and online casinos, political content, and any form of illegal activities. 

You must not at any time, invite or refer people who are unknown to you.

You must only use our Program for personal use and refrain from its use for commercial purposes. 

Term and Termination

This Program will run until we in our sole discretion decide to terminate the Program. We may also in our sole discretion notify users that the Program has ended with immediate effect.

Any referral made before the end of the Program can still participate. However we may exclude referrals in our sole discretion made after its termination date.

We may terminate this Program at any time, including your participation or the availability of its benefits.

Exclusive Relationship

You understand and agree that you are only the user of our services and/or products, and refrain from implying any other affiliation or legal relationship with us. 

You understand and agree that you are never authorized to legally bind our company. 

You must never create any materials that contain our branding, trademark, (part of) our corporate identity.

By participating in the Program you must not represent yourself in duplicate, agent or intermediary of our company

Amendments

We may amend the terms and conditions of our Program. We may offer and/or restrict additional incentives, benefits and programs. As a result, additional terms may apply. You agree that you are aware of those amended and additional terms.

Violations and Termination

In case we suspect any violations of these Terms or otherwise tampering with, fraud or unreasonable use of our Program, we may in our sole discretion cancel the distribution of any Reward. 

If you are a current or former employee, contractor or affiliate of our company, we may restrict your participation in the Program, and we may restrict or cancel your participation with immediate effect. 

You must comply with all applicable laws and regulations, and refrain from violating any third party rights. These rights include any copyright, trademark or other proprietary rights.

Disclaimer and Indemnification

We offer our Program and its benefits only on an “as is” and “as available” basis. We may remove, change and update the Program in our sole discretion. We will never make any promises or guarantees about the content and information of our Program. We disclaim our responsibility for any information that is incorrect or has errors. 

Our Program is based on our best efforts. You acknowledge and agree that we can never guarantee any benefit or result from participating in the Program.

You will defend, indemnify and hold Soundtrack Technologies harmless from and against all claims, damages, liabilities, losses, expenses and costs (including reasonable attorneys' fees) arising out of your participation in the Program.

No Correspondence, Disputes And Refunds

With regards to the distribution of discounts, vouchers, incentives, prizes, awards or other benefits, no correspondence will be entered into. Moreover, we shall never respond to any complaint or accept any dispute about the Program, and the above-mentioned benefits. are provided “as is” and we never refund or exchange such benefits. 

Applicable Law

The laws of the State of New York shall apply and federal or state courts in New York are competent to hear any claim that may arise out of these terms.
